Abstract
La transparencia se convierte en un elemento fundamental de la democracia participativa de la Unión Europea. El derecho al acceso a los documentos se regulará en un reglamento 2001 que construirá el marco jurídico de dicho derecho, finalmente consagrado por el tratado de Lisboa y por la Carta de Derechos Fundamentales. Las limitaciones de dicho reglamento exigen su organización, pero las instituciones europeas, fundamentalmente el Consejo plantean dificultades frente a la presión en favor de dicho derecho constitucional realizado por el Parlamento Europeo, el Tribunal de Justicia y la Defensoría del pueblo europea.

Transparency becomes a fundamental element of the participatory democracy of the European Union. The right of access to documents is regulated by a 2001 regulation, which establishes the legal framework for this right, ultimately enshrined by the Treaty of Lisbon and the Charter of Fundamental Rights. The limitations of this regulation require its organization, but the European institutions, primarily the Council, present challenges against the pressure in favor of this constitutional right exerted by the European Parliament, the Court of Justice, and the European Ombudsman.
