Abstract

This article deals not only with the constitutional and legal norms as regards the right of exception in Spain, but also with their application concerning the four cases which have occurred so far (This work covers up to 15 December 2021). Furthermore, the article highlights the gap between regulations and reality or how the mentioned right has been misapplied in most of the cited cases, while providing the underlying reasons.
