Derechos de los menores trans en España

Abstract

La invisibilización del colectivo trans ha provocado una pasividad normativa, tanto a nivel internacional como nacional, acentuándose este olvido, aún más, en la situación de los menores trans. Esta carencia de interés crea una situación de inseguridad y limbo jurídico para los menores trans en España al no encontrar un marco jurídico estatal o internacional al cual aferrarse. La invisibilización y la concepción social hegemónica y binarista abandona el libre desarrollo de la personalidad y el derecho a vivir de acuerdo con sus convicciones o sentimientos a los menores trans, situación que se intensifica con los estigmas, patologizaciones y discriminaciones sistemáticas fáticas y jurídicas que la sociedad tradicional plantea. Por ello, se pone de relieve los obstáculos legales y se estudia cuál es el desafío ante el que se encuentra la sociedad actual para la efectiva salvaguarda de los derechos humanos de los menores trans y asegurar su desarrollo personal de acuerdo con su identidad de género y personalidad. The invisibilization of the trans collective has provoked a normative passivity, both international and national, accentuating this neglect, even more, in the situation of transgender minors. This lack of interest creates a situation of insecurity and legal limbo for transgender minors in Spain when they do not find a state or international legal framework to which they can cling. The invisibilization and the hegemonic binarist social conception abandons the free development of the personality and the right to live according to their convictions or feelings to the transgender minors, a situation that intensifies with the stigmas, pathologizations and systematic phatic and legal discriminations that the traditional society poses. Therefore The legal obstacles are highlighted and the challenge faced by the current society for the effective safeguarding of the human rights of transgender children and ensure their personal growth according to their gender identity and personality is studied.
