The question of Gibraltar has been a thorn in the side for the relations among both States for three hundred years, and since the 1960s, for the international community. In this paper, the focus will be put on the role that the sea has played in the contentious, more specifically, on the question of sovereignty over the waters surrounding Gibraltar. To grasp the fundamental aspect of it, a historical and legal analysis will be carried on this topic, bearing in mind that it cannot be separated from the totality of the dispute.
