INTERNATIONAL PROTECTION ON THE BASIS OF SEXUAL ORIENTATION AND GENDER IDENTITY

Abstract

Violence based on sexual orientation and gender identity continues to be one of the main causes of forced displacement of LGBTI people in the world today. These individuals are not only fleeing generalized violence in their countries of origin, but are also victims of violence in transit and destination countries. However, the response that international law has been giving to the serious human rights violations of which LGBTI people are victims continues to be insufficient at present, as there is a clear discordance between the normative system of formal rights and guarantees and the real and effective enjoyment of these rights, particularly in relation to this group.
