Abstract

The relationship between judicial power and democracy is very close to the point that judicial power can be considered an essential element in democracy. Here the dangers are explored that threaten current democracies of some of the member States of the European Union when the judicial power is politicized and acts in party interests, which puts the separation of powers characteristic of the Rule of Law into question. We analyze how the premise that the judge cannot be an instrument of political power has recently gained a supranational prominence. A commitment to the principles of judicial ethics is proposed to fight against the politicization of the judicial power in the European Union.
