A vueltas con la independencia judicial y el órgano de gobierno de los jueces: el genuino caso del Consejo Superior de la Magistratura francés

Abstract

El objetivo de este trabajo consiste en demostrar si la configuración del Consejo Superior de la Magistratura francés ha logrado sobreponerse a los problemas inherentes que arrastra el poder judicial en Francia desde el inicio del Estado constitucional de Derecho. Así, se pretende determinar si esta institución sustenta la naturaleza jurídica que poseen los órganos de gobierno de los jueces. El fin es identificar si este Consejo asegura y salvaguarda la independencia judicial. En tal sentido, es necesario realizar un análisis contextualizado de esta institución y de las múltiples reformas constitucionales y legales a las que se ha visto sometida a lo largo de los sesenta y cinco años de vida de la V República. Finalmente, las conclusiones de este artículo se centran en determinar si los cambios normativos del Consejo han supuesto una transformación relevante de su naturaleza jurídica.

The aim of this paper is to demonstrate whether the configuration of the High Council for the French Judiciary has managed to overcome the inherent problems that the judicial power in France has suffered since the beginning of the constitutional rule of law. Thus, the aim is to determine if this institution supports the legal nature of the governing bodies of judges. The purpose is to identify if this Council ensures and safeguards judicial independence. In this sense, it is necessary to carry out a contextualized analysis of this institution and the multiple constitutional and legal reforms to which it has been subjected throughout the sixty-five years of the Fifth Republic. Finally, the conclusions of this study focus on determining whether the High Council’s regulatory changes have led to a relevant transformation of its legal nature.
