Del Estatuto de Bayona a la Constitución de 1812
Abstract
¿Carta otorgada o Constitución? Ésta es la pregunta que tanto constitucionalistas como historiadores del Derecho se hacen cuando se acercan a estudiar el conocido como Estatuto de Bayona y es la pregunta que nos acompañará durante esta ponencia en la que entroncaremos el citado estatuto con su influencia en la Constitución de Cádiz de 1812. Y es que es frecuente que los estudios de historia constitucional española adopten como punto de partida las Cortes de Cádiz y la Constitución de 1812; omitiéndose de este modo el importante constitucionalismo que germinó en España desde las últimas décadas del XVIII, con constitucionalistas de la talla de Jovellanos, León de Arroyal o Manuel de Aguirre, y también negando al Estatuto de Bayona su condición de primera constitución histórica española.
